Agreement to Terms
By accessing or using FairHealthCheck, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.
These Terms of Service ("Terms") govern your access to and use of the FairHealthCheck website, mobile application, and services (collectively, the "Service"). By using our Service, you agree to comply with and be bound by these Terms.

Service Description
FairHealthCheck is a platform that helps users analyze their medical bills by:
- Comparing medical charges against hospital-specific and state-wide pricing data
- Identifying potential overcharges and calculating possible savings
- Generating analysis reports and negotiation letters
- Providing access to community pricing averages and hospital statistics
We provide informational and analytical services only. We do not provide medical advice, legal advice, or financial advice. Our Service is intended to assist you in understanding and negotiating medical bills, but we cannot guarantee specific outcomes.
User Accounts
Account Registration
To use certain features of our Service, you must:
- Create an account by providing accurate and complete information
- Maintain and update your account information as necessary
- Be at least 18 years of age
- Maintain the security of your account credentials
Account Responsibilities
You are responsible for:
- All activities that occur under your account
- Maintaining the confidentiality of your password
- Notifying us immediately of any unauthorized use of your account
- Ensuring that all information you provide is accurate and current
Acceptable Use
You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Service for any illegal or unauthorized purpose

Medical Bill Uploads
When you upload medical bills to our Service:
- You represent that you have the right to upload and analyze the bill
- You grant us permission to process, analyze, and store the bill data
- You understand that we use this data to provide our comparison and analysis services
- You acknowledge that bill data may be stored securely for the duration of your account
Service Limitations and Disclaimers
No Medical Advice
FairHealthCheck does not provide medical advice, diagnosis, or treatment recommendations. Our Service is for informational and analytical purposes only. Always consult with qualified healthcare professionals for medical decisions.
No Legal Advice
We do not provide legal advice. While we may generate negotiation letters and provide pricing comparisons, we are not a law firm and cannot provide legal representation or advice. Consult with a qualified attorney for legal matters related to medical billing disputes.
No Guarantees
We cannot guarantee:
- That you will achieve specific savings or negotiation outcomes
- The accuracy or completeness of all pricing data in our database
- That hospitals will accept or respond to negotiation letters
- The availability or uninterrupted operation of the Service
Data Accuracy
All pricing information provided through the Service is for informational purposes only and may not reflect actual billed amounts, allowed amounts, patient responsibility, or pricing outcomes. Pricing data and related analytics may be incomplete, inaccurate, or change over time. You should independently verify all information with your healthcare provider and/or insurer before making any financial or medical billing decisions.
No Fiduciary Relationship
Your use of the Service does not create any fiduciary, advisory, or professional relationship between you and FairHealthCheck. We do not provide legal, medical, or financial advice, and any information provided by the Service is not a substitute for advice from qualified professionals.
Intellectual Property
The Service, including its original content, features, functionality, design, and branding (including the name “FairHealthCheck”), is owned by FairHealthCheck and is protected by applicable copyright and intellectual property laws.
FairHealthCheck may use names, logos, and branding associated with the Service. These may be protected under applicable trademark or common law rights, even if not registered.
You may not:
- Reproduce, distribute, or create derivative works from the Service
- Use our name, branding, or logos without prior written permission
- Reverse engineer, decompile, or disassemble our software
- Remove any copyright or proprietary notices
You retain ownership of the medical bills and data you upload. By uploading content, you grant us a limited, non-exclusive, worldwide license to use, process, store, and analyze that content solely to provide and improve our services.
Payment Terms
Fees
Some features of our Service may require payment. If you purchase a paid subscription or service:
- You agree to pay all fees associated with your purchase
- Fees are charged in advance and are non-refundable unless otherwise stated
- We reserve the right to change our pricing with notice
- All fees are in U.S. dollars unless otherwise specified
We may use third-party payment processors (such as Stripe) to handle billing and payments. By submitting payment information, you authorize us and our payment processors to charge applicable fees and process your payment in accordance with the applicable payment terms.
Refunds
Refund policies, if applicable, will be clearly stated at the time of purchase. Generally, fees for services already rendered are non-refundable.
Termination
Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.
Termination by Us
We reserve the right to suspend or terminate your account and access to the Service if:
- You violate these Terms of Service
- You engage in fraudulent, abusive, or illegal activity
- You fail to pay required fees
- We are required to do so by law
- We discontinue the Service
Upon termination, your right to use the Service will immediately cease. We may delete your account and data, subject to our data retention policies and legal obligations.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIRHEALTHCHECK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Business interruption
- Medical expenses or health-related consequences
- Legal fees or costs
- Any other damages arising from your use of the Service
Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless FairHealthCheck and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any content you upload or transmit through the Service
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Disputes arising out of or relating to these Terms or the Service shall be resolved in accordance with the Dispute Resolution section below, except where prohibited by law.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration on an individual basis, and not as part of a class action, except where prohibited by law.
Changes to Terms
We reserve the right to modify or update these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending an email notification for significant changes
- Displaying a notice on our website
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may terminate your account.
Medicare (Blue Button API) Consent
Some features require accessing Medicare claim information using the Blue Button API. You will be prompted to review and actively opt in to our Privacy & Security Policy and Terms of Service before we request access to your Medicare data.
- No default agreement: you must actively check the consent boxes to proceed.
- Purpose limitation: we use retrieved Medicare data only to compare against your uploaded bill and to generate Medicare insights and a negotiation letter.
- Security: Medicare access is performed via secure OAuth flows only with your explicit authorization; we do not ask you for your Medicare password.
- Compliance: we access Medicare data only in compliance with applicable CMS requirements.
- Availability: Medicare data availability may vary based on Medicare processing and provider responses.
